Terms of Service

These Terms of Service ("Terms") govern your access to and use of OneSiquijor's website, marketplace, and services (collectively, the "Services"). By using the Services you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. The Service

OneSiquijor is an online directory and booking marketplace that connects travelers with independent local businesses on Siquijor Island, Philippines ("Vendors"). OneSiquijor is not a party to any rental, accommodation, or tour agreement between you and a Vendor. We do not own, operate, control, or supervise any listed vehicle, accommodation, or guide service.

2. Eligibility & Accounts

You must be at least 18 years old to create an account or make a booking. You are responsible for the accuracy of the information you provide and for keeping your credentials confidential. You are responsible for all activity that occurs under your account.

3. Bookings & Payments

  • Bookings are confirmed directly with the Vendor, typically via WhatsApp, within approximately 2 hours of your inquiry.
  • Payment is made on arrival in cash or GCash, unless a Vendor specifies otherwise in writing.
  • All prices, availability, cancellation, and refund terms are set by the Vendor. OneSiquijor is not responsible for pricing errors, no-shows, or double bookings.

4. Vendor Terms

If you list a business on OneSiquijor, you additionally agree that:

  • You own or are authorized to represent the business you list.
  • Your listings, photos, and information are accurate, lawful, and do not infringe any third party's rights.
  • You will honor confirmed bookings and comply with all applicable Philippine laws, including LGU permits, DTI/BIR registration, and insurance requirements for the services you offer.
  • The Service is free for the first 90 days. Thereafter, OneSiquijor may charge a 10% commission on confirmed bookings. Fee changes will be communicated in advance.
  • You grant OneSiquijor a non-exclusive, royalty-free license to display your listing content on the Site and in related marketing.

5. Prohibited Conduct

  • Post false, misleading, illegal, or fraudulent content.
  • Circumvent, disable, or interfere with security features.
  • Scrape, harvest, or copy listings without written permission.
  • Use the Services to harass, defame, or harm others.
  • Upload malicious code or attempt unauthorized access.

We may suspend or terminate accounts that violate these Terms, at our sole discretion and without notice.

6. User Content

You retain ownership of content you submit but grant OneSiquijor a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute it as necessary to provide the Services. You represent that you have all rights required to grant this license.

7. Intellectual Property

The Site, its design, logos, and original content are the property of OneSiquijor and are protected by applicable intellectual property laws. You may not reproduce or create derivative works without written permission.

8. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. OneSiquijor does not warrant that the Services will be uninterrupted, secure, or error-free, or that any Vendor will perform as described.

9. Limitation of Liability

To the maximum extent permitted by law, OneSiquijor and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Services or any transaction with a Vendor. Our aggregate liability for any claim shall not exceed PHP 5,000 or the commissions we received from your booking in the preceding 12 months, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless OneSiquijor from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, your content, or your violation of these Terms.

11. Third-Party Services

The Services integrate with third parties (e.g. WhatsApp, payment apps, mapping providers). Your use of those services is governed by their own terms and privacy policies.

12. Termination

You may stop using the Services at any time. We may suspend or terminate your access, with or without notice, for any reason including breach of these Terms. Sections that by their nature should survive termination will survive.

13. Governing Law

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-laws principles. The courts located in Siquijor Province shall have exclusive jurisdiction over any dispute arising from these Terms, subject to your rights under mandatory consumer-protection law.

14. Changes

We may revise these Terms from time to time. Material changes will be posted on the Site with a new "Last updated" date. Continued use after changes constitutes acceptance.
